In consideration of being permitted to participate in the Sparrow Place 5K Fundraiser (the "Event"), organized by Sparrow Place, a non-profit organization (hereinafter "Sparrow Place"), I, the undersigned participant, for myself, my heirs, executors, administrators, and assigns, hereby acknowledge and agree to the following:

1. Acknowledgment of Risks:

I understand and acknowledge that participating in a 5K running/walking event, even a recreational one, involves inherent risks, dangers, and hazards. These risks include, but are not limited to: falls; contact with other participants, spectators, or vehicles; adverse weather conditions (heat, cold, rain, ice, snow); traffic; natural and artificial obstacles; defects in equipment; and the negligence of others, including participants, volunteers, organizers, and property owners. I further understand that these risks may result in serious injury, including but not limited to, sprains, fractures, concussions, heat stroke, hypothermia, cardiac arrest, permanent disability, or even death. I am voluntarily participating in this Event with full knowledge of these risks.

2. Assumption of Risk:

I hereby freely, voluntarily, and expressly assume all risks of injury, death, or property damage, whether foreseen or unforeseen, that may arise from my participation in the Event. I understand that this assumption of risk means I am solely responsible for any injury, illness, or damage that occurs to me or my property as a result of my participation, even if caused by the negligence of Sparrow Place, its officers, directors, employees, agents, volunteers, or sponsors.

3. Release and Waiver of Liability:

I, for myself, my heirs, executors, administrators, and assigns, hereby release, waive, discharge, and covenant not to sue Sparrow Place, its officers, directors, employees, agents, volunteers, sponsors, medical personnel, and all other persons or entities associated with the Event (collectively, the "Released Parties") from any and all liability, claims, demands, actions, and causes of action whatsoever, arising out of or related to any loss, damage, or injury, including death, that may be sustained by me, or to any property belonging to me, whether caused by the negligence of the Released Parties or otherwise, while participating in the Event, or while on the premises where the Event is being conducted.

4. Medical Treatment:

I certify that I am physically fit and have not been advised otherwise by a qualified medical professional to participate in this Event. I consent to receive medical treatment that may be deemed advisable in the event of injury, accident, or illness during the Event, and I release the Released Parties from any and all liability for any costs incurred or injuries sustained as a result of such treatment.

5. Indemnification:

I agree to indemnify and hold harmless the Released Parties from any and all claims, actions, suits, procedures, costs, expenses, damages, and liabilities, including attorney's fees, incurred by the Released Parties as a result of my participation in the Event, or any actions taken by me during the Event, including any claims brought by third parties.

6. Publicity Release:

I grant Sparrow Place and its authorized representatives permission to use my likeness, name, voice, and words in any photographs, videos, recordings, or other media taken during the Event for legitimate purposes, including but not limited to, publicity, marketing, and fundraising, without further compensation or notification.

7. Event Rules and Regulations:

I agree to abide by all rules, regulations, and instructions of the Event organizers and officials. I understand that failure to do so may result in my disqualification from the Event without refund.

8. Severability:

I agree that if any portion of this Waiver of Liability and Release Agreement is found to be unenforceable, the remaining portions shall remain in full force and effect.

9. Governing Law:

This Agreement shall be governed by and construed in accordance with the laws of the State of Pennsylvania, without regard to its conflict of laws principles.

I HAVE READ THIS WAIVER OF LIABILITY AND RELEASE AGREEMENT, UNDERSTAND ITS TERMS, AND I AM AWARE THAT BY SIGNING THIS AGREEMENT, I AM WAIVING CERTAIN LEGAL RIGHTS, INCLUDING THE RIGHT TO SUE.
